1. Acceptance of Terms
By accessing or using Pageraise, including its website and web application, you agree to be legally bound by these Terms of Use. These Terms govern your access to and use of the platform and form a binding agreement between you and Pageraise. If you do not agree to these Terms, you must stop using the platform immediately. Continued use of Pageraise constitutes acceptance of any updates or modifications. Pageraise may revise these Terms at any time, and updated versions will be effective upon posting.
2. Eligibility
Pageraise is available only to individuals who are at least 18 years old and capable of forming a legally binding agreement under applicable law. By using the platform, you represent and warrant that you meet these requirements. If you use Pageraise on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms. Pageraise does not knowingly permit use by individuals under 18 and reserves the right to suspend or terminate accounts that do not meet eligibility requirements.
3. Account Registration and Security
To access certain features, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify Pageraise immediately of any unauthorized use or security breach. Pageraise is not liable for losses resulting from unauthorized access due to your failure to safeguard account information.
4. User Responsibilities and Conduct
You agree to use Pageraise only for lawful purposes and in compliance with all applicable laws and regulations. You are responsible for all content you create, publish, or share, and for ensuring that your activities do not violate the rights of others. You must not engage in fraud, misrepresentation, deceptive practices, or any activity that could harm individuals, organizations, or the integrity of the platform.
5. Fundraising and Content Pages
Pageraise allows users to create pages to raise funds for personal, creative, or organizational purposes. All information provided on such pages must be accurate, complete, and not misleading. You must clearly describe the purpose of your fundraising and how funds will be used. You are solely responsible for fulfilling any representations or commitments made to contributors and for complying with all applicable financial, tax, and charitable solicitation laws. Pageraise does not guarantee the success of any fundraising activity and does not endorse any user or campaign.
6. Payments and Payment Processing
Pageraise facilitates payments through third party payment processors, including Stripe. To receive funds, you must create and maintain a valid account with the payment processor and complete any required identity verification. All transactions are subject to the payment processorβs terms, policies, and compliance requirements. Pageraise does not hold funds, process payments directly, or control payout timing. Pageraise is not responsible for payment failures, delays, chargebacks, reversals, or withheld funds resulting from processor actions, compliance reviews, or banking issues.
7. Fees
Pageraise may charge platform fees for use of its services. In addition, payment processing fees charged by third party providers such as Stripe will apply to transactions. All applicable fees will be disclosed to users before completing a transaction. You are responsible for reviewing and understanding all fees associated with your use of the platform.
8. Prohibited Activities and Content
You may not use Pageraise to engage in any unlawful, fraudulent, or harmful activity. Prohibited uses include but are not limited to money laundering, terrorist financing, impersonation, intellectual property infringement, deceptive fundraising, or the sale or promotion of restricted or regulated goods and services without proper authorization. Content that includes violence, exploitation, hate speech, harassment, or illegal material is strictly prohibited. Pageraise reserves the right to remove content and take enforcement action at its discretion.
9. Compliance and Verification
Pageraise may require identity verification, documentation, or additional information to comply with legal, regulatory, and payment processing obligations. Failure to provide requested information or failure to pass verification checks may result in restricted access, delayed payouts, or account termination. Pageraise may also monitor transactions and activity to detect fraud or violations of these Terms.
10. Account Suspension and Termination
Pageraise reserves the right to suspend, restrict, or terminate your account at any time if you violate these Terms, applicable laws, or payment processing requirements. Pageraise may also take action to protect users, prevent fraud, or comply with legal obligations. In certain cases, access to funds may be delayed or restricted where required by law or payment processor policies.
11. Disclaimers
Pageraise is provided on an as is and as available basis without warranties of any kind, whether express or implied. Pageraise does not guarantee uninterrupted or error free operation of the platform. To the fullest extent permitted by law, Pageraise disclaims all warranties, including fitness for a particular purpose, non infringement, and merchantability.
12. Limitation of Liability
To the maximum extent permitted by law, Pageraise and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of funds, revenue, data, or goodwill arising from or related to your use of the platform. Your sole remedy for dissatisfaction with the platform is to stop using it.
13. Indemnification
You agree to indemnify and hold harmless Pageraise and its affiliates from any claims, damages, liabilities, losses, and expenses arising out of or related to your use of the platform, your violation of these Terms, or your infringement of any rights of a third party.
14. Changes to Terms
Pageraise may update these Terms from time to time to reflect changes in legal requirements, technology, or business practices. Updated Terms will be posted on the platform with a revised effective date. Continued use of the platform after such changes constitutes your acceptance of the updated Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by and interpreted in accordance with the laws of the State of New York. Any disputes arising out of or relating to these Terms or your use of the platform shall be resolved exclusively in the state or federal courts located in New York, and you consent to the jurisdiction of such courts.
